Consultation on Derbyshire Minerals Local Plan
The Derbyshire and Derby Minerals Local Plan (2022-2038): Pre-Submission Draft Plan, under the Town and Country Planning (Local Planning) (England) Regulations 2004 ('the Regulations')
As you may be aware, Derby City Council and Derbyshire County Council, as the relevant Mineral Planning Authority for the area, are working in partnership to produce a new Minerals Local Plan for Derby and Derbyshire (outside the Peak District National Park) and have now published their Pre-submission Draft Plan ('the Plan').
The Plan sets out strategic priorities for mineral development through its Vision and Objectives and strategic policies to deliver sustainable minerals development and to ensure the continued supply of important minerals, including the identification of sites for mineral working. It also contains a set of policies which will be used to assess and determine new proposals for mineral development.

Attached is the Statements of Representations Procedure document, as required by Regulation 19 of the Regulations, regarding the procedure to use for making representations about the Plan, and where the proposed submission documents relating to it can be inspected.
We would welcome any comments you may have on the documents. As the Statement of Representations Procedure Document indicates, comments ("representations") about the Plan must be received by the end of Tuesday 2 May 2023. At this stage, comments should relate to the soundness and legal compliance of the Plan. The use of the attached Authorities' Representation Form is recommended. Guidance regarding the soundness and legal compliance requirements for a Local Plan is set out in the attached Guidance Note to accompany the Representation Form.
During the consultation period, we will be holding a series of Drop-in sessions. These will provide the opportunity for people to discuss the Plan with officers from the Councils. Details of the Drop-ins are as follows:

Following this regulatory consultation, the next main stage in the Minerals Local Plan process is expected to be the submission of the Plan, which, together with the representations made at this stage, will be examined by an independent Planning Inspector, in 2024. When adopted, the new Minerals Local Plan will provide the main policy guidance for assessing planning applications for minerals developments in Derbyshire and Derby.
